California Conceal and Carry Laws

Orange County Criminal Defense Lawyers

California has some of the strictest gun laws in the U.S., making it difficult to legally carry a weapon in the state. In fact, as of 2016, less than 1% of California residents possessed a valid CCW license.

If you’ve been charged with a firearms offense, do not wait to contact an Orange County criminal defense attorney at our office. The sooner you align yourself with an experienced attorney from our team, the sooner we can begin building an effective defense against your charges.

Concealed Carry Qualifications

In the state of California, a valid CCW license is required to lawfully own a weapon. Known as a “may issue” state, California sheriffs have the right to deny or issue permits.

Applicants must meet the following requirements:

  • Be at least 18 years of age
  • Be of good moral character
  • Have good cause for the permit
  • Show no signs of mental illness

A valid CCW permit allows the purchase, ownership, and possession of a firearm, as well as the ability to carry the loaded weapon concealed. California does not allow open carry at any time, even with a valid concealed carry permit.

Prohibited Groups

The state of California prohibits the following groups from obtaining a valid CCW permit:

  • People convicted of a felony
  • People convicted of certain misdemeanors, such as assault with a deadly weapon or brandishing a weapon
  • People suffering from a narcotic drug addiction

Legal and Illegal Weapons

California limits the types of firearms carried in the state by maintaining a list of approved weapons. Approved firearms include:

  • Pistols
  • Revolvers
  • Long rifles and shotguns*

*Long rifles and shotguns do not need to be concealed while carrying, but are still subject to grounds limitations as outlined by law, including carrying on or near school grounds or government buildings. The carrying or ownership of a short-barreled rifle or shotgun, undetectable firearm, or zip gun is strictly prohibited, and can lead to criminal charges. If not listed, it is best to ask an attorney regarding the legality of your weapon.
