Driving under the influence (DUI) is the criminal act of driving a motor vehicle while under the influence of drugs or alcohol; and/or driving a motor vehicle with a Blood Alcohol Concentration (BAC) of 0.08% or higher. Once a person has been arrested for (DUI), his/her driving privileges may be at risk. When a person is arrested for DUI, his/her driver’s license is confiscated by law enforcement. The person is then provided with a temporary permit which allows them to drive for 30 days. After 30 days, the person’s driving privileges are automatically be suspended, unless he/she schedules a hearing with the Department of Motor Vehicles (DMV) to contest his/her license suspension.
From the date of the person’s arrest, he/she only has 10 days to contact the DMV and schedule his/her DMV Hearing. After the person has scheduled his/her hearing with the California Department of Motor Vehicles, he/she will be issued a time and date in which he/she must appear at his/her local DMV. During the DMV Hearing, a DMV representative will meet with the person in a designated room. If the DMV representative finds that the person is guilty, the person will lose his/her driving privileges for a set period of time. However, if the DMV representative finds that the person is not guilty, the person’s driving privileges will be reinstated.
